Lund v. Keene, Clackamas County Case No. CV12100792
Mr. Lund was on his motorcycle in the Fred Meyer’s parking lot in Oregon City. Another vehicle took a too-wide-turn and struck Lund. He suffered from knee and neck pain. the knee resolved but the neck continued to cause problems for months after the crash. Finally an MRI revealed several disc protrusions to be the cause of his pain.
The at-fault-driver had State Farm. They denied the disc injury was caused by the crash. They also argued that even if it was, the injury did not require surgery. Mr. Lund’s neurosurgeon suggested surgery but Lund did not have it. The defense treated the case as a minor injury case.
We filed a lawsuit in Clackamas County Circuit Court. A settlement conference was held and the judge explained that he thought we might lose on the issue of whether surgery was necessary to fix the disc. we disagreed. Finally, State Farm increased their offer to $145,000 and the case was settled.
