Morlan v. State Farm Insurance, Multnomah County Case No. 19CV05819
An uninsured driver failed to yield to a blinking yellow light, proceeded into an intersection, and collided with Plaintiff Morlan. Plaintiff Morlan brought this action for uninsured motorist benefits against her own insurance company – Defendant State Farm. Morlan claimed that the crash caused him to suffer a torn adductor magnus muscle, acetabular impingement, and soft-tissue injuries to his neck, shoulder, back, wrist, and leg. He sought damages for past medical expenses of $40,000, future medical expenses of $10,000, and non-economic damages of $250,000 as well as reasonable attorney fees per ORS 742.061.
Defendant State Farm admitted that there was coverage for the event and that Mr. Morlan was injured in the crash but disputed the extent of Mr. Morlan’s damages.
