Plaintiff Tyler was a pedestrian walking across the street on SE 121st and Division. Defendant Tower struck Tyler with the vehicle she was driving. Tyler alleged that Tower was negligent for failing to keep a proper lookout and control her car. Tyler claimed accident-related soft-tissue injuries to his shoulder, knee, neck, and back. He sought $10,000 in non-economic damages and attorney fees according to ORS 20.080.
