Tyler v. Tower, Multnomah County Case No. 16CV41422
Plaintiff Tyler was a pedestrian walking across the street on SE 121st and Division. Defendant Tower struck Tyler with the vehicle she was driving. Tyler alleged that Tower was negligent for failing to keep a proper lookout and control her car. Tyler claimed accident-related soft-tissue injuries to his shoulder, knee, neck, and back. He sought $10,000 in non-economic damages and attorney fees according to ORS 20.080.
Tower alleged that Tyler’s injuries were due to his own negligence. She claimed that Tyler was wearing dark clothing, stepped off the curb suddenly and was not in a crosswalk.
